CAMPAIGN TO RAISE AWARENESS OF HOW CHARITIES IMPROVE THE QUALITY OF CANADIAN LIVES CONTEST (THE "CONTEST") The purpose of the Contest is to have entrants create and submit an original concept for a campaign that could lead to increased public awareness of the role that Canada’s charities play in ensuring and improving the quality of life in Canada. The purpose of the campaign cannot be to seek donations for charities.
OFFICIAL CONTEST RULES AND TERMS AND CONDITIONS (the "Rules") By submitting an entry into the Contest, the entrant (“you”) acknowledge and agree in favour of Imagine Canada and The Muttart Foundation (hereinafter referred to as the “Project Sponsors”) along with our advertising and promotional agencies and their respective directors, employees, agents and representatives that: (i) you are eligible to enter the Contest; and (ii) you have read, understood and agree to be bound by these Rules, as follows: Eligible Contest Participants - No Purchase Necessary The Project Sponsors invite entries by all permanent residents of Canada who are at least 18 years of age and no older than 35 years of age on November 30, 2012, and who are registered as a full-time student anytime during the period of January 9, 2012 and March 31, 2013 in a Canadian post secondary educational institution that is registered as a charity by the Canada Revenue Agency. Employees of Imagine Canada and The Muttart Foundation, and members of their immediate family, are not eligible to enter. The Contest begins at 12:01 am ET January 15, 2012 and ends 11:59:59 pm ET April 30, 2013 (the “Competition Period”). Contest Entry To enter the Contest, you must create and submit a fully developed original concept for a public awareness campaign that could lead to increased public awareness of the role that Canada’s charities play in ensuring and improving the quality of life in Canada by November 30, 2012. Your Entry may be submitted in ENGLISH and/or FRENCH. You may submit more than one Entry in each language. Each Entry must be original and distinct from any previous Entry. The decision of the Judges is final. No entry materials will be returned. Format Requirements Your Entry should consist of a concept for a proposed campaign that could lead to increased public awareness of the role that Canada’s charities play in ensuring and improving the quality of life in Canada. The campaign could focus on the breadth, the variety and/or the work of the charitable sector (and other not-for-profit organizations), careers in the charitable sector or any other issue that highlights the scope, importance and/or involvement of the charitable sector in the lives of Canadians. The purpose cannot be to ask for increased donations to charities and entries which seek donations will be disqualified. Your Entry may consist of one or more formats, including but not limited to text, drawing(s) or storyboard(s), photograph(s), an audio or video file(s), or any other information or material, provided the file, information or material can be presented or viewed physically, or electronically. Entries may include more than one file in the same or different formats.
By submitting an entry in the Contest, you consent to,
and agree to be bound by these Rules Please note that if your Entry is being submitted by a team of eligible participants, you will be asked on the entry form to provide consent and a single email address for receiving notices relating to the Contest. All individuals whose portrait, photograph, recorded image, voice and statements appear in your Entry must give their written consent to your use and the Project Sponsor’s or other authorized parties use of their portrait, photograph, recorded image, voice, name, likeness and statements in your Entry. The Project Sponsors may ask you for the names and contact information of the individuals who appear in any fashion in your Entry in order to verify that consent has been given. If there is any question of the identity of the entrant or group of entrants responsible for any Entry, the Project Sponsors may but are not required to verify the identity of the entrant(s). If the identity of the entrant(s) is not verified, the Entry will be disqualified. Participants consent to fully cooperate with the Project Sponsors in any effort, before or after the awarding of prizes, to confirm or obtain legal rights or obligations related to use of the material. If there is any question as to the holder of any intellectual property right or rights pertaining to, or associated with, any Entry, the Project Sponsors may but are not required to verify the identity of the holder(s) of the right(s). If the identity of the holder(s) is not verified, the Entry may be disqualified in the sole discretion of the Project Sponsors. Participants consent to fully cooperate with the Project Sponsors in any effort, before or after the awarding of prizes, to confirm intellectual property rights related to the material or its use. Entries Entries must be original (i.e. Entries cannot include anything created by someone who is not the entrant or group of entrants). You, as the entrant or group of entrants, must own all of the intellectual property or other rights in or to the Entry. Entries must be solely created by the entrants; however guidance from a teacher or faculty member is permitted. Entries which contain materials that are infringing, illegal, unlawful, defamatory, discriminatory, violent, obscene, pornographic or likely to expose any person or group of persons to ridicule, embarrassment or hatred, that purports to sell or promote any product or service, offensive to community standards of decency, or in any other way non-compliant with these Rules, all as determined by the Project Sponsors in their sole and absolute discretion, may be disqualified by the Project Sponsors in their sole discretion. Your Entry may be disqualified by the Project Sponsors in their sole discretion if you are associated with any materials on-line or elsewhere that are inconsistent with the mandate, mission or goals of the Project Sponsors, or that would be contrary to the spirit of this Contest. Prizes The judging panel will select six winning entries by May 31, 2013. The Prizes shall be allocated as follows:
The odds of winning a prize depend on the number and quality of eligible Entries received. Selected Entrant Notification The Project Sponsors or their representatives will attempt to contact each entrant whose Entry is selected as a finalist in Phase 1 by telephone and/or e-mail for a period of seven (7) days following their selection as a Finalist. If that entrant cannot be contacted within the seven (7) day period, they will not be eligible to participate in Phase 2 of the Contest. The Project Sponsors or their representatives will attempt to contact each entrant whose Entry is selected as one of the 6 winners of Phase 2 by telephone and/or e-mail for a period of seven (7) days following the Judging Period. If that entrant cannot be contacted within the seven (7) day period, or if contacted, the entrant does not sign and return the Project Sponsors’ Declaration and Release Form (see below) within 4 days of being contacted by the Project Sponsors, the Project Sponsors have the right to disqualify that selected Entry and to cause the Judges to select the Entry of another Finalist. Declaration and Release Before being declared one of the six Contest winners, the selected entrants must sign and return to the Project Sponsors the Project Sponsors’ Declaration and Release form: a) confirming compliance by the entrant with these Rules; b) consenting to participating in the prize package; c) confirming that you have obtained the consent of all individuals whose portrait, photograph, recorded image, voice and statements appear in the Entry; and d) releasing, indemnifying and holding harmless the Project Sponsors and their affiliates, officers, directors, employees, agents, dealers, advertising and promotional agencies, and the Judges, from all liability relating to the Contest, participation in the Contest, and the acceptance of and participation in the prize package. Personal Information By participating in the Contest, you expressly consent to voluntarily providing all of the personal information contained in your Entry (your “Personal Information”) to the Project Sponsors for the purposes of operating and administering the Contest, including but not limited to: (i) contacting you about your Entry; (ii) promoting your Entry as one of the winning Entries; or (iii) contacting you in the future with information regarding the Project Sponsors and their activities. You expressly consent to the use of such Personal Information by the Project Sponsors or any party acting under the authority of the Project Sponsors (an “Authorized Party”) for the purposes listed above and you acknowledge and agree that the collection and use by the Project Sponsors shall be subject to the terms of Imagine Canada’s privacy policy. Should you be selected as one of the six (6) Contest winners, you further consent to the Project Sponsors conducting a background check of any and all public records, including the social media for anything concerning you or your Entry that would be inconsistent with the mandate, mission or goals of the Project Sponsors and the Contest. License and Use By submitting an Entry, you grant to the Project Sponsors, a perpetual, non-commercial, royalty-free, worldwide license to use your Entry and any images or videos provided with or included in your Entry (in whole or in part and in any format), as contemplated herein and expressly waive all rights of publicity, privacy and moral rights, if any, therein and irrevocably waive any right that you may have to inspect or approve of, or receive any compensation in respect of the uses of same, for any and all purposes contemplated in these Rules. You further agree that you will not license use of the Entry or associated images or videos to anyone without prior written permission from the Project Sponsors. Imagine Canada and The Muttart Foundation shall have the right to sub-license use of the Entry or associated images or videos. Imagine Canada and The Muttart Foundation will use their best efforts to ensure that those submitting winning entries are appropriately identified in uses of the material. You consent to Imagine Canada and/or The Muttart Foundation and any applicable Authorized Party and/or any licencees of the Project Sponsors posting to its Website and reproducing, printing, publishing, broadcasting and otherwise using your Entry and your name, image and city of residence in connection with your Entry, as well as any image or videos provided with or included in your Entry, in connection with: (a) the Contest; (b) any advertising and promotion in any media related to the Contest, including without limitation, in any advertising materials or via e-mail communication and/or news releases (collectively, the “Permitted Uses”), without further compensation and without limitation as to time or territory; any campaign launched subsequent to the Contest to promote increased public awareness of the role that Canada’s charities play in ensuring and improving the quality of life in Canada . You acknowledge that, if your Entry is selected as one of the winning entries in the Contest, the Project Sponsors and/or their licencees shall also have the right, but not the obligation, to use your Entry (in whole or in part and as may be edited or modified at the sole and absolute discretion of The Project Sponsors), in one or more television commercials, website materials, posters, brochures or other advertising (the “Advertising”) for such purposes as The Project Sponsors may see fit, without further compensation of any kind whatsoever. Laws The Contest is subject to all applicable federal, provincial, and municipal laws and regulations. These Rules are governed by and shall be interpreted in accordance with the domestic laws of the Province of Alberta, without regard to conflicts of laws and, by entering this Contest; entrants agree to attorn to the jurisdiction of the courts of Alberta. Liability You irrevocably and unconditionally release, discharge and hold harmless The Project Sponsors, and all other parties acting under right, title, assignment, grant or license from The Project Sponsors or Authorized Parties, from any and all claims, demands, actions, causes of actions, suits or proceedings of any kind or nature whatsoever, and from any injury, loss, damage, debts, liability, costs or expenses of any kind whatsoever which you or any other person claiming through you may have, suffer or incur, as a result of or arising from or in connection with any use of your Entry, any image or video of yourself provided with or included in your Entry, or other material contemplated by these Rules, including without limitation, any claims for libel, defamation, invasion of privacy, or breach of publicity or other property rights. You further indemnify and save harmless the Project Sponsors and Authorized Parties from and against any and all suits, actions, causes of action, claims and demands whatsoever (and any costs or expenses relating thereto) which may be made or brought by any person against, or otherwise suffered or incurred by, the Project Sponsors and Authorized Parties, or any of them, as a result of or arising in any way in connection with any breach by you of any undertaking or agreement under these Rules. For Quebec residents only: Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Other The Project Sponsors shall not be responsible for print or typographical errors in any Contest-related materials. All Entries become the property of the Project Sponsors, which assume no responsibility for lost, stolen, delayed, damaged, misdirected incomplete, illegible entries or for failure of any entry to be received by the Project Sponsors for any reason whatsoever. The Project Sponsors, their advertising and promotion agencies and the Judges will not be liable for any injury or damage to an entrant related to or resulting from participating or attempting to participate in the Contest. Any attempt to deliberately damage or undermine the legitimate operation of this Contest is a violation of the law, and should such an attempt be made, the Project Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law. Subject to applicable laws, the Project Sponsors reserve the right to modify, suspend, cancel or terminate the Contest. |
